๐ ๐ผ๐ฟ๐ฒ ๐ฆ๐ฝ๐ฎ๐ป๐ถ๐๐ต ๐ฎ๐ป๐๐ถ๐๐ฟ๐๐๐ ๐น๐ถ๐๐ถ๐ด๐ฎ๐๐ถ๐ผ๐ป – As commented on many other occasions, private antitrust litigation in Spain is quite complex and far from a sure claim to be won. If recently it was in the case of the so-called ‘๐ฐ๐ฎ๐ฟ ๐ฐ๐ฎ๐ฟ๐๐ฒ๐น’, now it is the turn of the ‘๐บ๐ถ๐น๐ธ ๐ฐ๐ฎ๐ฟ๐๐ฒ๐น’ with a new ruling against the claimant.
Unlike the criteria of the Spanish competition watchdog, the CNMC, the courts are favourable to the dairy industry. The latest case: ๐๐ต๐ฒ ๐๐ผ๐๐ฟ๐ ๐ผ๐ณ ๐๐ถ๐ฟ๐๐ ๐๐ป๐๐๐ฎ๐ป๐ฐ๐ฒ ๐ก๐ผ๐ฎ ๐ผ๐ณ ๐๐๐ด๐ผ, ๐๐ฎ๐น๐ถ๐ฐ๐ถ๐ฎ, one the main areas in the dairy industry.
As mentioned in the attached article, the court has dismissed the lawsuit filed by a farmer for โฌ๐ญ.๐ฐ๐ฏ ๐บ๐ถ๐น๐น๐ถ๐ผ๐ป against several companies in the sector for allegedly anticompetitive conduct sanctioned by the CNMC.
Interestingly, the court also ordered the farmer to ๐ฝ๐ฎ๐ ๐๐ต๐ฒ ๐ฐ๐ผ๐๐๐ ๐ผ๐ณ ๐๐ต๐ฒ ๐ฝ๐ฟ๐ผ๐ฐ๐ฒ๐ฒ๐ฑ๐ถ๐ป๐ด๐, including the costs incurred by the defendants in hiring lawyers, experts and attorneys.
The ruling is a significant setback for the claimants in addition to other similar judgments that have also ruled against the farmers, such as the judgment of the Commercial Court of Oviedo number 1, dated January 20, 2022, and the decision issued, also, by the Court of First Instance number 2 of Lugo, last June 3, 2022.
